This Privacy Policy describes how we collect, use, disclose, and protect personal information obtained through our websites (including www.monumentrealty.com and any property-specific sites we operate) and through our offline interactions with clients, tenants, investors, and other business partners. By using our websites or providing personal information to Monument, you agree to this Privacy Policy to the extent permitted by applicable law.

2. Updates to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices or applicable laws. The date this Privacy Policy first took effect is shown as the “Effective Date” at the top of this page, and the date of the most recent revision is shown as the “Last Updated Date.” Any updates will take effect when the revised policy is posted on this page. We encourage you to review this Privacy Policy periodically. Continued use of our websites or services after changes are posted constitutes acceptance of the revised Privacy Policy.

3. Information We Collect

We may collect the following types of information from you, both online and offline:

  • Contact Information: Name, address, phone number, email address, and similar identifiers.
  • Application or Tenant Information: Details provided when you inquire about or apply to lease a unit, including employment, income, and references. We also collect consumer reports (which are background screening reports and may include credit, criminal, or eviction history) from third-party screening services, only with your prior written authorization and disclosure as permitted by the Fair Credit Reporting Act (FCRA) and applicable District of Columbia housing laws. We obtain such consumer reports only through authorized third-party screening providers and do not retain your full credit report after screening is completed.
  • Business Information: For investors, vendors, and partners – business name, title, payment details, and tax identification information.
  • Website Usage Information: IP address, browser type, operating system, referring URLs, pages visited, and general usage data collected through cookies or analytics tools such as Google Analytics.
  • Communications: Records of your communications with us, including inquiries submitted through web forms or by email. We do not knowingly collect personal information from children under 13 years of age. If we learn that we have inadvertently collected personal information from a child under 13, we will promptly take steps to delete that information.

4. How We Use Information

We use personal information to:

  • Provide information, services, and customer support you request;
  • Process rental applications, manage properties, administer leases, and conduct tenant screening in compliance with the FCRA and District of Columbia fair housing and human rights laws;
  • Communicate with residents, applicants, vendors, and investors;
  • Send updates about Monument properties, news, and events (you may opt out of marketing emails at any time by clicking “unsubscribe” in any marketing email or contacting us at info@monumentrealty.com); you may also opt out of marketing communications at any time by contacting us directly at info@monumentrealty.com.
  • Improve our websites, advertising, and user experience;
  • Comply with legal obligations or enforce our agreements.

If we take adverse action based on a consumer report, we will provide notice as required by the FCRA. We do not sell your personal information or share it for cross-context behavioral advertising as those terms are defined under applicable privacy laws.

5. Cookies and Analytics

Our websites use cookies and other tracking technologies, including third-party analytics tools such as Google Analytics. These tools collect information like your IP address, pages visited, and general usage data to help us measure traffic patterns, improve site performance, and inform our marketing and advertising campaigns (including retargeting). You can control cookies through your browser settings or by using Google’s opt-out tools at https://tools.google.com/dlpage/gaoptout.

By using our websites, you acknowledge and agree to the processing of data by Google in the manner and for the purposes set out in the following link: How Google uses information from sites or apps that use our services (www.google.com/policies/privacy/partners/). Rejecting cookies may limit certain website features but will not prevent you from accessing core property information or contact forms.

6. Information Sharing

We may share your information only in the following limited circumstances

  • Service Providers: With third-party vendors who help us operate our business (e.g., website hosting, property management systems, marketing, or payment processing). These parties are contractually required to protect your information and use it only for authorized purposes.
  • Legal Requirements: When required by law, court order, or government request, or to protect our rights, property, or users.
  • Business Transfers: If Monument is involved in a merger, acquisition, or asset sale, personal data may be transferred as part of that transaction.

We do not disclose personal data to unaffiliated third parties for their own marketing use.

7. Security

We use industry-standard administrative, technical, and physical safeguards – such as firewalls, encryption, and access controls – to protect personal information from loss, misuse, unauthorized access, or disclosure. However, no system is completely secure, and we cannot guarantee absolute security of your data.

8. External Links

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Specifically, we retain tenant and applicant records, including screening reports and lease documents, for at least three (3) years following the termination of the tenancy or rejection of the application, or longer if required to comply with District of Columbia property management, housing or anti-discrimination laws, whichever period is longer. Rejected applicant files are retained for at least three (3) years. We may retain certain information longer if necessary to protect our legal rights or maintain accurate business and financial records.

10. Your Choices

Consistent with District of Columbia laws and regulations, you have the right to request access to the personal information we hold about you and request its deletion, subject to legal exceptions (such as our need to retain records for housing, anti-discrimination, or financial compliance). We will respond to your request in accordance with applicable law, including the laws of the District of Columbia. Residents of certain states, including California, Virginia, and others with applicable privacy statutes, may have additional rights under their respective privacy laws (such as the California Consumer Privacy Act, or “CCPA”).
